Welcome to BellaBoo & Co! By purchasing or subscribing to our personalized pet-themed products, you agree to the following Terms & Conditions. These terms outline your rights, responsibilities, and what you can expect from our service. Please read them carefully.

1. Subscription Overview

Monthly Subscription: Subscribers receive one personalized item every month.

Quarterly Subscription: Subscribers receive one personalized item every three months.

Loyalty Discounts:

  • Monthly subscribers receive 10% off their 4th box after completing 3 shipments.
  • Quarterly subscribers receive 20% off their 4th box after completing 3 shipments (one full year of quarterly boxes).
  • Loyalty discounts are automatically applied for qualifying customers.

Additional Details:

  • Eligibility: Subscriptions are available to customers aged 18 and older and are limited to delivery addresses within the United States.
  • Renewals: Subscriptions automatically renew unless canceled. (See “Subscription Terms & Cancellation Policy” for more details).
  • Non-Subscribers: Customers who prefer not to subscribe can explore our one-time purchase option (see Section 2 for details).

2. One-Time Purchase Option

One-Time Purchase: Customers may purchase a single custom item without subscribing.

What’s Included:

  • One personalized product designed using your pet’s photo and breed.
  • The design will follow BellaBoo & Co’s on-brand style, and the pet’s name will be included if it fits seamlessly with the design.

Photo Requirements:

  • Submitted photos must meet quality standards (clear, high-resolution images). BellaBoo & Co reserves the right to request a replacement image if the submitted photo does not meet these standards, which may delay production.

Shipping:

  • One-time purchases will ship within 5 business days of order confirmation. This timeframe refers to processing and shipment; delivery times may vary based on the customer’s location.
  • Shipping & Taxes: Shipping and taxes are included in the listed price. There are no additional fees at checkout.

Returns:

  • Due to the personalized nature of the product, one-time purchases are non-refundable unless the item arrives damaged.
  • Reporting Damaged Items: Customers must report damaged items within 7 days of delivery by contacting info@bellaboo.co with a description of the issue and photos of the damaged item and packaging.

3. Product Expectations

At BellaBoo & Co, each product is thoughtfully crafted to reflect your pet’s unique personality. Here’s what you can expect:

Personalized Products:

  • Each item is custom-designed using the photo you submit, featuring creative elements that celebrate your pet.

Design Process:

  • BellaBoo & Co will create an on-brand design inspired by your pet’s photo and breed. Pet names will be included if appropriate for the design.
  • Customers may not request specific design alterations or preview proofs, as this could delay the production process.

Attention to Detail:

  • We will try our best to capture the details of your pet accurately. However, due to the artistic and creative nature of the designs, some details may not be an exact match.
  • Slight variations in color or details may occur due to the printing process.

Photo Limitations:

  • BellaBoo & Co reserves the right to request a new photo if the submitted image does not meet quality standards (e.g., blurry, low-resolution, or inappropriate content). This may result in a delay in production.

Unique Experience:

  • No two designs are identical, ensuring every product is truly one of a kind. BellaBoo & Co retains full creative discretion over the final design.

4. Photo Submissions

To create your custom product, BellaBoo & Co requires a high-quality photo of your pet that meets the following requirements:

Usage & Editing:

  • By submitting your pet’s photo, you agree that BellaBoo & Co has the right to use, edit, and modify the photo as needed to create your custom product.
  • BellaBoo & Co will not share your original photo publicly without edits or alterations.

Submitted photos must meet quality standards, including:

  • Clear and in-focus images.
  • High resolution.
  • Proper lighting (not overly dark or bright).
  • Unobstructed views of the pet (e.g., no cropped features or heavy shadows).

Replacement Photos:

  • If your submitted photo does not meet our quality standards, BellaBoo & Co will notify you and request a replacement.
  • Customers must provide a replacement photo within 7 days of notification to avoid order cancellation or shipment delays.
  • If no replacement photo is provided within this timeframe, BellaBoo & Co reserves the right to cancel the order and issue a partial refund, excluding processing or setup fees.

Customer Responsibilities:

  • Customers are responsible for ensuring they own the rights to the photos submitted or have obtained permission to use them.
  • By submitting a photo, you confirm that the image does not infringe on any third-party rights, including copyrights or trademarks.

5. Ownership of Designs

All designs created by BellaBoo & Co using your submitted photo are the sole intellectual property of BellaBoo & Co.

Intellectual Property Rights:

  • BellaBoo & Co retains exclusive rights to reproduce, use, and share these designs for marketing, advertising, promotional purposes, or other business-related activities.
  • Designs may be altered or edited for these purposes and will not include customer-provided personal details such as last names unless otherwise
    agreed upon.

Customer Rights:

  • Customers are granted the right to use the physical product for personal purposes only.
  • Ownership of the design itself (including any digital or printed representations) remains with BellaBoo & Co. Customers are not granted any rights to reproduce, distribute, or modify the design.

Prohibited Use by Customers:

  • Customers may not reproduce, copy, alter, resell, or use the design for any commercial purposes, including but not limited to resale, advertising, or marketing.

Exceptions:

  • Custom use of the design for commercial or other purposes may only be authorized by BellaBoo & Co with prior written agreement.

6. Subscription Terms & Cancellation Policy

Minimum Commitment:

  • Subscribers are required to maintain their subscription for a minimum of 3 shipments (either 3 months for the monthly subscription or 9 months for the quarterly subscription).

Cancellation Process:

  • Customers may cancel their subscription anytime after completing 3 shipments by visiting their account dashboard or contacting us at info@bellaboo.co.

Cancellations Before 3 Shipments:

  • If you cancel before fulfilling the 3-shipment minimum, BellaBoo & Co reserves the right to charge a cancellation fee of up to $20. This fee accounts for the discounts, setup, and custom work provided during your subscription.
  • BellaBoo & Co may also charge a prorated amount for any discounts received on previous shipments.

Re-enrollment Policy:

  • If a customer cancels their subscription before completing the 3-shipment minimum and later attempts to re-enroll, BellaBoo & Co reserves the right to reject the new subscription and cancel it at our discretion.

Automatic Renewal:

  • Subscriptions automatically renew unless canceled. Customers will receive an email reminder at least 5 days prior to the renewal of their subscription, allowing time to review, cancel, or update the subscription as needed.
  • Cancellations must be made at least 3 days prior to the renewal date to ensure the next shipment is not processed. Cancellations made after this time may result in the shipment and billing for the next cycle.

Late Cancellations:

  • If a cancellation is made after the 3-day cutoff, the customer may still be charged, and the shipment for the next cycle will be processed. In such cases, the subscription will be canceled for future cycles after the current shipment is completed.

Refund Policy for Partial Cycles:

  • If a customer cancels mid-cycle after completing the 3-shipment minimum, BellaBoo & Co does not offer refunds for any remaining time in the current cycle. The subscription will remain active until the end of the paid period.

Grace Period for New Subscribers:

  • First-time customers may request a cancellation within 24 hours of subscribing if no customization work has begun. If work has already started, cancellation will follow the standard policy.

7. Pricing, Payment & Unpaid Charges

Pricing:

  • The current pricing for all products and subscriptions is displayed on our website and is subject to change.
  • Price changes will apply to new subscriptions only. Existing subscriptions will retain their original pricing unless explicitly stated and agreed upon by the customer.
  • All prices are listed in USD and include shipping and taxes.

Prepaid Subscriptions:

  • Prepaid subscriptions are non-refundable. If a prepaid subscription is canceled, customers will continue to receive shipments for the remainder of the prepaid term but will not receive a refund.
  • Exceptions may apply in cases of service disruptions caused by BellaBoo & Co (e.g., if we are unable to fulfill shipments).

Unpaid Charges:

  • If a payment fails, BellaBoo & Co will notify the customer via email and allow a grace period of 5 business days to update their payment method and resolve the issue.
  • During this time, the subscription may be placed on hold. If payment is not resolved within 30 days, BellaBoo & Co reserves the right to:
  • Suspend or cancel the subscription.
  • Charge a late fee of $10 or 5% of the outstanding balance, whichever is higher.
  • Pursue collection efforts for unresolved balances.

Customers are responsible for maintaining valid payment methods. Failed payments may result in delayed or canceled orders.

8. Shipping & Delivery

One-Time Purchases: Ships within 5 days of order confirmation.

Subscription Boxes:

  • Monthly boxes ship on the 1st of each month.
  • Quarterly boxes ship on the 1st of each quarter.

Order Processing for New Subscriptions:

  • If a subscription is placed close to the shipment date (e.g., on the 31st), we will not be able to ship by the 1st. Instead, BellaBoo & Co will process the order and ship it within 7 days of the order date. Recurring shipments will then begin on the 1st of the following cycle.
  • Example: A subscription placed on January 31st will ship by February 7th. The next box will ship on March 1st for monthly subscribers or April 1st for quarterly subscribers.

Delays: BellaBoo & Co is not responsible for shipping delays caused by incorrect shipping information, carrier issues, or external factors beyond our controlincluding but not limited to shipping carriers and payment processors..

If a shipment is returned due to an incorrect or incomplete shipping address provided by the customer, the customer will be responsible for any additional shipping fees to reship the product.

9. Refunds & Returns

Personalized Items: Due to their custom nature, all sales are final. Refunds, returns, or exchanges are not permitted unless the product arrives damaged.

Damaged Items: If your item arrives damaged, contact us within 7 days at info@bellaboo.co with photos for review.

BellaBoo & Co may, at its sole discretion, approve a refund for cancellations made prior to the start of the production process. Such refunds will exclude any administrative fees incurred.

10. Accuracy of Customer Information

Customers are responsible for providing accurate and complete information, including valid shipping addresses and high-quality photo submissions.

BellaBoo & Co is not liable for delays or issues resulting from inaccurate information provided by the customer.

11. Confidentiality & Non-Disclosure

BellaBoo & Co will not disclose your personal information or submitted photos to third parties, except as necessary to fulfill your order or as required by law.

Customers agree not to share or reproduce BellaBoo & Co’s proprietary designs, processes, or marketing materials without prior written permission.

BellaBoo & Co handles customer data in accordance with our [Privacy Policy], which outlines how personal information is collected, used, and protected. By using our services, you consent to our Privacy Policy.

12. Licensing Information

By subscribing or purchasing, you are granted a limited, non-transferable, personal license to use the physical product for personal purposes only.

Customers do not own any copyright or intellectual property rights associated with the design or BellaBoo & Co branding.

13. Force Majeure Clause

BellaBoo & Co is not liable for delays or disruptions in service caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, or supply chain interruptions.

14. Disclaimer of Warranties & Limitation of Liability

All products and services provided by BellaBoo & Co are offered "as is" without warranties of any kind, either express or implied. BellaBoo & Co is not responsible for incidental or consequential damages arising from the use of our products or services.

15. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of West Virigina, without regard to its conflict of law provisions.

16. Modifications to Terms & Conditions

BellaBoo & Co reserves the right to update or modify these Terms & Conditions at any time. Customers will be notified of significant changes via email at least 30 days in advance.

17. Termination of Subscriptions

BellaBoo & Co reserves the right to terminate a subscription at any time if the customer violates these Terms & Conditions, engages in fraudulent activity, or provides inaccurate or incomplete information.

BellaBoo & Co reserves the right to suspend a customer's account or withhold shipments if fraudulent activity or misuse of our services is suspected. If fraud is confirmed, the subscription may be terminated immediately.

18. Customer Communication Consent

By purchasing or subscribing, you agree to receive communications from BellaBoo & Co related to your order status, subscription details, account updates, and promotional offers.

Promotional communications may include emails, SMS messages, or other forms of digital marketing.

Customers may opt out of promotional communications at any time by clicking the "unsubscribe" link in emails or by contacting info@bellaboo.co.

Please note that transactional communications (e.g., order confirmations or shipping updates) are essential to the service and cannot be opted out of.
